A US $ 3.2 billion (24 thousand 233 crore) railway contract between Kenya and China Road and Bridge Corporation (CRBC) is invalidated by a Kenyan court. The Court of Appeal handling the cases arising out of the decisions of the High Court in Kenya observed that Kenya’s railway standard had failed to comply with the country’s law and in violation of the country’s law “in procurement” of multinationals. The contract was signed under the Belt and Road Initiative (BRI), South China Morning Post (SCMP).
Kenyan activist Okiya Omtah and a group of advocates by the Law Society of Kenya sued in 2014 to stop the creation of SGR. He said that the railway was a public project which should have been subject to a fair, competitive and transparent procurement process. The plaintiff said that despite the burden of debt repayment on Kenyan taxpayers, the agreement was reached without compromising for the tender.
