Aatmja Kumari(Intern Journalist): The Chhattisgarh High Court has quashed government orders prohibiting private unaided schools from depositing tuition fees or recovering dues from their students. A bench of Justice P Sam Kosi has clarified that the state cannot issue such a “general order” to prohibit private schools from depositing fees, as it would not allow any business or business under Article 19 of the Constitution of India Will adversely affect their right to guarantee.

The court has allowed all schools belonging to the petitioner- Society, Bilaspur Private School Management Association Society to charge tuition fees from its students, including the outstanding fees for the previous academic session.
This order is however made subject to the following conditions:
• It is expected that educational institutions will not increase or revise their tuition fees until the situation is normalized and corrected; Tuition fees should be the same as those charged for the previous academic session.
• The respective schools will allow the payment of fees monthly, bi-monthly or quarterly whichever is convenient for parents, and all options are also open to parents.
• Until the situation becomes normal, schools must ensure that they only submit tuition fees and no fees other than tuition fees.
• No institution will be allowed to withhold part of the salary nor will the schools reduce the salary of any of their current employees, which was given to these employees before the lockdown period.
The order has been passed as per the observations made by the High Courts of Delhi, Punjab, and Haryana and Kerala, to allow educational institutions to deposit tuition fees so that they can meet their infrastructure expenses and online To run classes.
