New Delhi: The Supreme Court on Friday acquitted a person who was ever convicted in the murder case, giving the benefit of the doubt. In the murder case registered in Madhya Pradesh in 2008, three people, including this person, were sentenced to death under sections 302 (murder) and 34 (common intention) of the Indian Penal Code.
‘Sentencing was heard in 2012’
Later, in 2012, the Madhya Pradesh High Court said that the death sentence, in this case, is not correct and sentenced the three to life imprisonment. The person challenged the High Court verdict which sentenced him to life imprisonment in the Supreme Court in 2013, saying that there is no evidence against him in this case.
SK Kaul and KM Joseph ruled
In their 43-page judgment, Justice SK Kaul and K.M. Joseph said that the person was convicted of other crimes including murder on the basis that the deceased’s mobile phone was found from him, but the recovery of that mobile phone is in doubt itself.
Acquitted on murder charges
The bench said that it would not be safe/true to uphold the sentence of the appellant in view of the facts of the case. The bench acquitted the person with the murder charge, along with several other remarks.
